TERMS & CONDITIONS

After the two required monthly payments have been made, the renter can choose to:

1. Continue the rental on a month-to-month basis

2. Return the instrument to Nick Rail Music (NRM) or one of its affiliates

3. Purchase a new instrument with rental trade credit

Initial Rental Payment will be charged when a serial number is assigned to the contract. Nick Rail Music will attempt to contact by phone, text, or email Renter when serial number is assigned. It is the responsibility of the renter to collect the instrument within seven days of assignment. If instrument is not collected within seven days, the contract will be canceled. The Initial Rental Payment is non-refundable. Initial Rental Payment includes: instrument rental fee, liability waiver fee (if selected), set up fee, and tax.

RENTAL CONTRACT & RENTAL TRADE CREDIT

THIS IS NOT A RENT-TO-OWN CONTRACT. The rental instrument itself cannot be purchased. However, 100% of the rental payment (minus tax and service fees) will accrue for the first 24 months and may only be used toward a NEW instrument in the same instrument family (brass, woodwind, orchestral string, concert percussion). Rental Trade Credit can only be used toward an instrument of equal or greater value than the rented instrument and will be applied toward the Manufacturer Suggested Retail Price. Rental Trade Credit is NONTRANSFERABLE and MAY NOT BE COMBINED with other promotions or rental accounts. Rental Trade Credit may not be used toward combo instruments: guitar, electric bass, keyboard, drum set, etc. In addition, a 35% discount off the remaining balance (after the Rental Trade Credit has been applied) is available during the first 90 days of rental. The purchase option is only available upon return of the rental instrument and terminates thereafter.

Payments other than rent, (tax, liability waiver, late fees) do not count toward accrued Rental Trade Credit. Rental contract must be current to exercise the Purchase Option.

EXCHANGE POLICY

The rental instrument may be exchanged for another at any time during the life of the contract. The first month’s rent for the new instrument is due at the time of exchange. All accrued rental trade credit will apply to an exchange instrument of equal or greater value. If exchanging for an instrument of lesser value, rental trade credit will equal the amount of rent that would have been paid had the instrument of lesser value been rented from the start.

THEFT & DAMAGE LIABILITY WAIVER & RESPONSIBILITY FOR RETURN

NRM will waive renters liability for stolen or damaged rental instruments if enrolled in Theft and Damage Liability Waiver. If instrument is stolen, a police report must be filed within 48 hours of the theft and a copy submitted to NRM within 10 days. Willful destruction, gross negligence, or loss will not be covered and customer will be held fully responsible. For instruments replaced due to theft or destruction, all rental credit will transfer to a new contract with an instrument of similar condition and quality. Under no circumstances shall a rental instrument be repaired by anyone other than NRM.

Without this waiver the renter assumes full financial responsibility for the rental, including damage beyond normal wear and tear (as defined by NRM), and theft or loss of the rental, including any or all of its component parts, as outfitted at time of rental.

The renter is required to maintain the rental and is solely responsible for its return, as outfitted, in the same condition, subject to reasonable wear and tear as defined solely by NRM. The instrument must be returned directly to NRM or one of its affiliates. RENTAL INSTRUMENT RETURNS ARE NOT TO BE LEFT AT OR TURNED IN TO SCHOOLS OR OTHER 3RD PARTIES unless such action has been specifically coordinated and authorized by NRM management. PAYMENTS AND ADDITIONAL CHARGES

Following the initial one-month rental payment, monthly rental payments are due at Nick Rail Music, 1770 Orange Tree Lane, Redlands, CA 92374 on the commencement date of each monthly payment period. The minimum, nonrefundable rental period is two months. A $10.00 late fee is assessed on the 10th day past due. At thirty days past due the account is considered delinquent and may be transferred to a collection agency. The renter will be liable for cost of collection, including but not limited to legal fees and/or other collection fees (up to 30% of the amount due) incurred by NRM in regaining the instrument and/or in collecting past due payments. There is a $30.00 charge for returned checks and declined bank debits. All penalties and charges are added to the account balance; all monies paid on an account are applied first to penalties and then to rental. This contract requires a major credit card for security purposes. It is the renter’s responsibility to maintain an active credit card on file and to inform NRM of any change in the status of the card. If a credit card charge is declined, NRM will resubmit the transaction until it is no longer declined, for a period of up to two weeks.

ENFORCEMENT, FAILURE TO RETURN, CHOICE OF VENUE & CREDIT AUTHORIZATION AND ACCURACY

In the event of any litigation of this contract, the prevailing party shall be entitled to recover reasonable legal fees, whether or not such litigation proceeds to a final judgment or determination. When payment cannot be made in a timely manner, the instrument must be returned promptly. Failure to return the instrument and equipment may be considered a violation of California law and subject the renter to additional costs, late fees and penalties. Renter agrees that NRM shall have the right to repossess the instrument wherever it may be found, including any educational institution, with or without the knowledge of the renter. This agreement shall be construed in accordance with and governed by the laws of the state of California without giving effect to choice of law. Any legal proceeding or action relating to this agreement shall be brought or otherwise commenced in a state court located in the county of Santa Barbara, California. Terms and Conditions may change at any time.

NRM is authorized to check any information provided by the renter to confirm the accuracy of such information and the renter’s credit worthiness. Signer agrees to authorize NRM and its agents to communicate by phone, email, or text message and through the use of an auto-dialer or prerecorded phone call at the telephone numbers provided. Renters must be at least 18 years old. The rental contract contains all terms of the agreement between the renter(s) and NRM. No oral representations or changes to this rental contract shall be valid unless contained in a written document signed by both the renter(s) and an authorized representative of NRM.

COMMUNICATION AND CONSENT

Renter consents to receiving informational and promotional SMS text messages related to musical instruments and events directly related to Nick Rail Music and its affiliates via an automated SMS text message platform. The number must belong to the Renter. It is understood that consent is not a condition of any future purchase. Standard message and data rates may apply. Renter may unsubscribe at any time by replying STOP or be requested through any of our store locations.

Contrato de alquiler y crédito comercial de alquiler

Este no es un contrato tipo “RENT-TO-OWN” donde se puede comprar el instrumento que se está inquilando. Sin embargo, 100% del pago del alquiler (menos impuestos y tarifas de servicio) se acumulará durante los primeros 24 meses y solo se puede utilizar para un nuevo instrumento en la misma familia de instrumentos (latón, viento de madera, cuerda de orquesta, percusión de concierto). El crédito comercial de alquiler solo se puede utilizar para un instrumento de igual o mayor valor que el instrumento alquilado y se aplicará al precio minorista sugerido por el fabricante. El crédito comercial de alquiler no es transferible y no se puede combinar con otras promociones o cuentas de alquiler. El crédito comercial de alquiler no puede utilizarse para instrumentos combinados: guitarra, bajo eléctrico, teclado, batería, etc. Además,  un descuento del 35% del saldo restante (después de que se haya aplicado el crédito comercial de alquiler) está disponible durante los primeros 90 días de alquiler. La opción de compra solo está disponible al devolver el instrumento de alquiler y finaliza a partir de entonces.

 

Los pagos que no sean alquiler (impuestos, exención de responsabilidad, cargos atrasados) no cuentan para el crédito comercial de alquiler acumulado. El contrato de alquiler debe estar vigente para ejercer la opción de compra.

 

Politica de intercambio

 El instrumento de alquiler puede ser cambiado por otro instrumento durante la vida del contrato. El primer mes de alquiler del nuevo instrumento debe pagarse al momento del cambio. Todo el capital acumulado se aplicara a un instrumento de intercambio de igual o mayor valor. Si se intercambia por un instrumento de menor valor, el capital sera igual al monto del alquiler que se habria pagado si se hubiese alquilado desde el principio el instrumento de menor valor.

 

Exención de responsabilidad por robo y daños y responsabilidad por devolución

NRM renunciará a la responsabilidad del inquilino por los instrumentos de alquiler robados o daños por un pago mensual de $6.00. Si el instrumento es robado, un informe de la policia debe ser presentado dentro de las 48 horas del robo y debe enviarse a NRM dentro de 10 dias. La destrucción intencional o la negligencia grave no se cubrirán y el cliente será plenamente responsable. Para los instrumentos reemplazados por robo o destrucción, todo el crédito de alquiler se transferirá a un nuevo contrato con un instrumento de condición y calidad similares. Bajo ninguna circunstancia se llevara un instrumento alquilado a reparar con nadie más que NRM. 

 

Sin esta excención, el arrendatario asume la responsabilidad financiera por el alquiler, incluido el daño más allá del desgaste normal (según lo define NRM) y el robo o la pérdida del alquiler, incluyendo cualquiera o todos sus componentes, como se equipa al momento del alquilar. 

 

El arrendatario está obligado a darle mantenimiento al instrumento alquilado y es el único responsable de regresarlo, en la misma condición, sujeto al desgaste razonable que defina exclusivamente NRM. LOS INSTRUMENTOS DE ALQUILER NO DEBEN DEJARSE O ENTREGARSE A ESCUELAS U OTRAS PERSONAS, a menos que esto haya sido coordinado y autorizado especificamente por la gerencia de NRM. Pagos y cargos adicionales

 Después del pago inicial de un mes de alquiler, los pagos de alquiler deben hacerse a Nick Rail Music, 1770 Orange Tree Lane, Redlands, CA 92374 en la fecha de inicio de cada período de pago mensual. El mínimo período de alquiler, no reembolsable, es de dos meses. A los diez dias de mora se hará un cargo de $10.00. A los treinta días de mora el instrumento se considera robado y la cuenta puede ser transferida a una agencia de cobros. El arrendatario será responsable del costo del cobro, incluidos, entre otros, los honorarios legales y/u otros honorarios (hasta 30% de monto adeudado) incurridos por NRM para recuperar el instrumento y/o cobrar los pagos vencidos. Hay un cargo de $30.00 por cheques devueltos y débitos bancarios rechazados. Todas las multas y cargos se agregan al saldo de la cuenta; todos los fondos pagados en una cuenta se aplican primero a las multas y luego al alquiler. Este contrato requiere una tarjeta de crédito por motivos de seguridad. Es responsabilidad del arrendatario mantener una tarjeta de crédito activa en el expediente e informar a NRM de cualquier cambio en el estatus de la tarjeta. Si se rechaza un cargo de tarjeta de crédito, NRM volverá a intentar la transacción hasta que no se rechace, por un período de hasta dos semanas.

 

Aplicación, no devolución, elección de jurisdicción y precisión de la tarjeta de crédito

 En caso de cualquier litigio de este contrato, la parte que prevalezca tendrá derecho a recuperar los honorarios razonables de abogados, bien sea que dicho litigio proceda hasta una sentencia o determinación firme, o no. Cuando no pueda hacerse el pago de una manera oportuna, el instrumento debe ser devuelto con prontitud. No devolver el instrumento y equipos puede ser considerado una violación de las leyes de California y ocasionar costos y multas adicionales al arrendatario. El arrendatario acepta que NRM tendrá el derecho de recuperar el instrumento dondequiera que se pueda encontrar, incluyendo en cualquier institución educativa, con o sin el conocimiento del arrendatario. Este acuerdo se entenderá de acuerdo, y se regirá bajo, las leyes del estado de California sin dar efecto a elección de la ley. Cualquier procedimiento o acción legal relacionados con este acuerdo será llevado o iniciado en una corte estatal ubicada en el condado de Santa Bárbara, California. Los terminos y condiciones pueden  cambiar en cualquier momento.

 

NRM está autorizado para revisar cualquier información proporcionada por el arrendatario para verificar la exactitud de dicha información y la situación crediticia del arrendatario. El firmante acuerda autorizar a NRM y a sus agentes para que se comuniquen por teléfono, correo electrónico o mensaje de texto, y también a través del uso de marcado automático o llamadas telefónicas pregrabadas en el telefóno provisto. Los inquilinos deben tener al menos 18 años de edad. El contrato de alquiler contiene todos los términos del acuerdo entre el arrendatario y NRM. Ninguna representación oral o cambio sobre este contrato de alquiler será válido a menos que figure en un documento escrito firmado tanto por el inquilino como por un representante autorizado de NRM.

 

Comunicacion y Consentimiento

 

El arrendatario consiente en recibir mensajes de texto SMS informativos y promocionales relacionados con instrumentos musicales y eventos vinculados directamente a Nick Rail Music y sus filiales, a traves de una plataforma automatizada de mensajeria SMS. El numero debe pertenecer al arrendatario. Se entiende que este consentimiento no es condicion para realizar ninguna compra futura.  Pueden aplicarse tarifas estandar de mensajeria y datos. El arrendatario puede cancelar la suscripcion en cualquier momento respondiendo con la palabra “STOP” o solicitandolo en cualquiera de nuestras tiendas.
